These Terms of Service (“Terms”) govern your use of CallJolt, a product of Twin Lightning Digital Agency Corp (“CallJolt,” “we,” “us,” “our”). By creating an account or using our Service, you agree to these Terms.
1. Service Description
CallJolt provides an AI-powered phone answering service for plumbing, HVAC, and other service businesses. The Service includes:
- AI voice assistant that answers incoming calls on your behalf.
- Call recording, transcription, and summarization.
- SMS notifications to you (the business owner) with call details.
- Appointment scheduling via Google Calendar integration.
- A web dashboard to review calls, appointments, and customer data.
2. Eligibility
You must be at least 18 years old and authorized to enter into contracts on behalf of your business. By using CallJolt, you represent that you have the authority to bind your business to these Terms.
3. Account Registration
You agree to provide accurate, complete information when creating your account and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4. Subscription and Billing
Pricing
CallJolt is offered as a monthly subscription. Current pricing is available at calljolt.com. We reserve the right to change pricing with 30 days' notice.
Payment
Subscription fees are billed monthly in advance via Stripe. You authorize us to charge your payment method on file for all applicable fees.
Cancellation
You may cancel your subscription at any time through your dashboard or by contacting support@calljolt.com. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.
Free Trials
If offered a free trial, you will not be charged until the trial period ends. If you do not cancel before the trial ends, your payment method will be charged for the first month.
5. Acceptable Use
You agree not to:
- Use CallJolt for any unlawful purpose or in violation of any applicable laws or regulations.
- Use the Service to make outbound telemarketing calls or send unsolicited SMS messages.
- Provide false or misleading information to callers through your AI assistant configuration.
- Attempt to circumvent security measures, access other users' data, or interfere with the Service.
- Resell or sublicense the Service without our written consent.
- Use the Service to handle calls related to illegal activities.
6. SMS Terms
By subscribing to CallJolt, you consent to receive SMS notifications related to the Service, including call summaries, emergency alerts, appointment confirmations, and account updates.
- Message frequency: Varies based on call volume. You may receive multiple messages per day.
- Message and data rates may apply depending on your mobile carrier and plan.
- To opt out: Reply STOP to any message, or disable SMS in your dashboard settings.
- For help: Reply HELP to any message, or contact support@calljolt.com.
- Supported carriers: Major US carriers including AT&T, T-Mobile, Verizon, and others. Carrier support is not guaranteed.
7. Call Recording and Consent
CallJolt records calls handled by your AI assistant. You are responsible for complying with all applicable call recording laws in your jurisdiction, including but not limited to:
- Federal wiretapping laws (18 U.S.C. 2511).
- State-specific recording consent requirements (one-party vs. two-party consent states).
Your AI assistant is configured to identify itself as an AI. It is your responsibility to ensure your call handling complies with local laws. CallJolt is not liable for your failure to comply with recording consent requirements.
8. Data Ownership
- Your Business Data: You retain ownership of your business information, call recordings, transcripts, customer data, and appointment records. We process this data on your behalf to provide the Service.
- Caller Data: Information provided by callers during calls is collected to provide the Service to you. You are responsible for handling caller data in accordance with applicable privacy laws.
- Service Data: We retain the right to use aggregated, anonymized data for service improvement and analytics purposes.
Upon account cancellation, you may request an export of your data within 90 days.
9. Third-Party Services
CallJolt integrates with third-party services including Twilio, Vapi.ai, Google Calendar, and Stripe. Your use of these integrations is subject to those providers' terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.
10. Service Availability
We strive for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible).
- Third-party service outages (Twilio, Vapi.ai, etc.).
- Force majeure events.
If the AI assistant is unavailable, calls may be directed to voicemail as a fallback.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- CallJolt is provided “as is” without warranties of any kind, express or implied.
- We are not liable for missed calls, failed SMS deliveries, incorrect AI responses, scheduling errors, or any damages arising from use of the Service.
- Our total liability for any claim arising from or related to the Service is limited to the amount you paid for the Service in the 3 months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
12. Indemnification
You agree to indemnify and hold harmless Twin Lightning Digital Agency Corp, its officers, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Any content or instructions you configure in your AI assistant.
13. Termination
We may suspend or terminate your account if you:
- Violate these Terms.
- Fail to pay subscription fees after notice.
- Use the Service in a manner that threatens the security or integrity of the platform.
We will provide reasonable notice before termination except in cases of serious violations.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the dashboard at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved in the courts of Los Angeles County, California.
